Texas Chapter 604 - Gift Cards & Gift Certificates

Texas law regulates gift cards and gift certificates in Chapter 604 of the Texas Business and Commerce Code. Here are some gift card laws in Texas:

Expiration dates
There are no restrictions on how far in advance a gift card can expire, but the expiration date must be clearly disclosed.
Fees
Service fees are prohibited unless certain conditions are met. Issuers can charge reasonable fees for handling, access, reissue, or replacement. Other fees must be reasonable and not start until at least one year after the card is issued.
Refunds
Texans can receive refunds on gift cards with balances under $2.50. The transaction must take place in person.
Unclaimed gift cards
Unredeemed gift card balances become unclaimed property in the Texas Comptroller's Office after the card expires or three years after it was issued. The state eventually takes ownership of the balance
unless the owner contacts the comptroller's office to claim it.
